Sample Email Disclaimers

I created a post the other day about email disclaimers. I was surprised at how many people privately emailed me to ask for samples. I thought everyone in the world already had a disclaimer of choice, but apparently not.

Here are several examples you might want to use, or compare to your own. One is my definite favorite, although not used very often, and hopefully it will be clear as to which I’m referring.

Sample #1

THIS ELECTRONIC MAIL TRANSMISSION IS PRIVILEGED AND CONFIDENTIAL AND IS INTENDED ONLY FOR THE REVIEW OF THE PARTY TO WHOM IT IS ADDRESSED. IF YOU HAVE RECEIVED THIS TRANSMISSION IN ERROR, PLEASE IMMEDIATELY RETURN IT TO THE SENDER. UNINTENDED TRANSMISSION SHALL NOT CONSTITUTE WAIVER OF THE ATTORNEY-CLIENT OR ANY OTHER PRIVILEGE.

** TAX ADVICE DISCLOSURE **

PURSUANT TO INTERNAL REVENUE SERVICE CIRCULAR 230, WE ARE REQUIRED TO ADVISE YOU THAT IF THERE IS ANY TAX ADVICE CONTAINED HEREIN, IT IS NOT INTENDED TO BE USED, AND CANNOT BE USED, BY THE ADDRESSEE OR ANY TAXPAYER, FOR THE PURPOSE OF AVOIDING PENALTIES THAT MAY BE IMPOSED UNDER THE INTERNAL REVENUE CODE.

Sample #2

This email is for the use of the intended recipient(s) only. If you have received this email in error, please notify the sender immediately and then delete it. If you are not the intended recipient, you must not keep, use, disclose, copy or distribute this email without the author’s prior permission. We have taken precautions to minimize the risk of transmitting software viruses, but we advise you to carry out your own virus checks on any attachment to this message. We cannot accept liability for any loss or damage caused by software viruses. The information contained in this communication may be confidential and may be subject to the attorney-client privilege. If you are the intended recipient and you do not wish to receive similar electronic messages from us in future then please respond to the sender to this effect.

Sample #3

This message contains information which may be confidential and privileged. Unless you are the intended addressee (or authorized to receive for the intended addressee), you may not use, copy or disclose to anyone the message or any information contained in the message. If you have received the message in error, please advise the sender by reply at xyz@xyzfirm.com and delete the message.

I am a lawyer, but I am not your lawyer (unless you have been in my office and signed a contract). This communication is not intended as legal advice, and no attorney client relationship results. Please consult your own attorney for legal advice.
